Houghton Mifflin Harcourt Publishing Company Wins Civil Proceeding against All India Traveler Bookseller (AITBS)

BOSTON — January 23, 2008 — Houghton Mifflin Harcourt Publishing Company has won a civil proceeding against an unauthorized publisher All India Traveler Bookseller (AITBS) that concluded with a permanent injunction in favor of Houghton Mifflin Harcourt and a satisfactory payment in settlement of all claims. The Criminal proceedings against AITBS also came to an end on 9th January 2008.

In April 2006 Houghton Mifflin Company brought Criminal and civil proceedings against All India Publishers and Distributors (AIPD) and All India Traveler Bookseller (AITBS), two Delhi based publishers of unauthorized reprints of Houghton Mifflin textbooks. Police carried out raids and seized thousands of pirated textbook copies from the unauthorized publishers and registered cases under Section 63 and 65 of the Indian Copyright Act for infringement, and Sections 420 and 120-B of the Indian Penal Code for cheating and criminal conspiracy against the accused publishers. Houghton Mifflin Harcourt has been represented in these proceedings by the Indian IP Law firm Akash Chittranshi & Associates.

Civil and Criminal proceedings initiated against AIPD, owned and operated by Rajinder Kumar Arya, continue in the Indian Courts with interim injunctions having been issued in favor of Houghton Mifflin, while police are continuing to investigate criminal copyright offenses and violations of other provisions of the Indian Penal Code.
